Terms of use

Terms for the OpenPulse website, @handle claim flow, and free invite-only previews operated by AUVY GmbH. Paid or production services require a separate order or express acceptance.

1. Provider and scope

The provider is AUVY GmbH, Am Haag 8, 82166 Gräfelfing, Germany ("AUVY", "OpenPulse", "we"). These terms apply when you use openpulse.org, claim an @handle, or receive access to a free preview without a separate agreement.

Requesting access does not create an entitlement, subscription or paid contract. If an order form, enterprise agreement, data processing agreement or product-specific terms apply, those documents prevail for their subject matter.

2. Eligibility and accounts

You must have legal capacity to use the service. If you act for an organisation, you confirm that you may bind or administer access for that organisation. You must provide accurate information, protect credentials and recovery material, and notify us promptly of suspected compromise.

Handles must not impersonate another person or organisation, violate rights, mislead users, or be reserved primarily for resale. We may reject, suspend or reassign a handle where reasonably necessary to address abuse, infringement, security risk or a verified superior right.

3. Preview status and availability

Preview services are pre-general-availability. Features, limits, interfaces and data formats may change. We may limit or withdraw access, but will use reasonable efforts to provide notice where practical. No service-level commitment, permanent storage promise or production-readiness warranty applies unless stated in a separate signed agreement.

Keep independent copies of important data and keys. Do not use a preview as the sole system for safety-critical, emergency, regulated, or irreversible transactions.

4. Acceptable use

You must comply with the Acceptable Use Policy. In particular, do not use OpenPulse for unlawful content, spam, malware, exploitation, rights infringement, deceptive identity, attacks on systems, or attempts to bypass access, rate, security or payment controls.

5. Your data and content

You retain rights in content and data you submit. You grant us the limited rights necessary to host, route, secure and support the service. You are responsible for having a lawful basis and the permissions required for data you send through OpenPulse.

Our handling of personal data is described in the Privacy Notice. An organisation using managed OpenPulse for others may be the controller and may need a data processing agreement before production use.

6. OpenPulse rights and open source

OpenPulse names, marks, hosted interfaces and non-public service components remain owned by AUVY or its licensors. Open-source SDK and protocol code is governed by the licence published with that code; these hosted-service terms do not replace an open-source licence.

You may give feedback. Unless agreed otherwise, we may use feedback without restriction or payment, while avoiding disclosure of your confidential information.

7. Suspension and termination

You may stop using a free preview at any time. We may suspend or terminate access for a material breach, security risk, unlawful use, harm to others, legal requirement, or discontinuation of the preview. Where the issue can reasonably be cured, we will normally give notice and an opportunity to cure.

Provisions that by their nature should continue — including ownership, liability and governing law — survive termination. Data deletion follows the Privacy Notice and any separate agreement.

8. Warranty and liability

Statutory rights that cannot be excluded remain unaffected. For free previews, the service is provided without a guarantee of uninterrupted or error-free operation and with the preview limitations described above.

We are liable without limitation for intent and gross negligence, injury to life, body or health, fraudulent concealment, an expressly assumed guarantee, and liability under the German Product Liability Act. For ordinary negligence, we are liable only for breach of a material contractual duty and only for foreseeable damage typical of the contract. Where legally permitted, the same limitations apply to our representatives and agents.

9. Governing law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country in which a consumer habitually resides remain unaffected. For merchants, public-law entities and special public-law funds, the exclusive venue is Munich, Germany.

We are not obliged or willing to participate in dispute-resolution proceedings before a consumer arbitration board.

10. Changes and contact

We may update these terms for future use to reflect service or legal changes. Material changes affecting an active managed service will be communicated reasonably in advance where required. The version accepted for an existing paid agreement is not replaced retroactively unless that agreement permits it.
